1. Parties and Subject Matter

This EQ BİLET User Agreement (“Agreement”) is entered into between ÖZGÜR PRODÜKSİYON DAĞITIM TURİZM ORGANİZASYON DANIŞMANLIK TİC. LTD. ŞTİ. (“EQ BİLET”) and natural persons who purchase/use any event tickets, products, and services offered for sale through the EQ BİLET website (https://www.eqbilet.com
), EQ BİLET mobile application (if any) and/or other physical and digital channels where EQ BİLET products/services are offered (collectively, the “Sales Platform”) (each a “User”, collectively “Users”).

This Agreement governs the terms and conditions relating to the sale and use of all event tickets, products, and services offered via the Sales Platform.

By using the Sales Platform and/or registering as a member, the User acknowledges that they have read and understood this Agreement, agrees to be bound by its terms, and undertakes not to act in violation of these terms and applicable laws. Once a purchase is confirmed for any ticket or service ordered via the Sales Platform, the User’s payment obligation arises.

2. Right to Amend

EQ BİLET reserves the right to amend this Agreement unilaterally at any time. The updated version shall enter into force upon being published on the Sales Platform. Users acknowledge and irrevocably accept that such amendments will be effective for them as of the time of publication.

Sales Platform and Membership
3. Nature of the Sales Platform

EQ BİLET is the owner and operator of the Sales Platform. EQ BİLET facilitates and/or sells entry tickets for concerts, theatre, cinema, dance performances, opera, stand-up, festivals, competitions, sports events, museums and archaeological sites, exhibitions, cultural and entertainment venues, and other artistic, cultural, sporting and/or other events (each an “Event”, collectively “Events”), and may also offer other products and services related to its core activity via the Sales Platform.

4. Changes to Services and Campaigns

EQ BİLET may, at its sole discretion:

make services that do not require membership later require membership, or vice versa;

convert free services into paid services and introduce additional products/services;

modify, transform, suspend or discontinue any service;

create member-only campaigns and benefits and later terminate them.

In short, EQ BİLET has sole discretion and authority over any services offered on the Sales Platform.

Membership
5. Creating an Account

By registering on the Sales Platform, the User creates a password. The email address and/or phone number used during registration are unique to the User, and only one account may be created with the same email address and/or phone number. The password selected by the User is known only to the User.

The User may change their password at any time. Selecting, keeping confidential, and safeguarding the password is solely the User’s responsibility. The User irrevocably agrees not to hold EQ BİLET liable for any disputes or damages arising from third-party use of the password. To access membership-only services, the User must enter the email/phone and password used at registration.

6. Termination of Membership

The User may terminate their membership at any time. EQ BİLET reserves the right, without stating any reason, to cancel a User’s membership, change the nature of the services, and/or discontinue services. The User acknowledges and accepts that EQ BİLET has this right and authority.

Users
7. Capacity and Accuracy of Information

By accessing the Sales Platform, Users declare that they are of legal age (18+) and have full legal capacity under Turkish law; that they have read and understood this Agreement in full; and that they unconditionally accept all its provisions. Unless proven otherwise, EQ BİLET may rely on these declarations.

Users must provide complete and accurate information in the user information form. Any liability arising from incorrect information or information belonging to third parties shall belong to the relevant User.

8. Guest Checkout (Purchase Without Membership)

Users who purchase tickets/products without membership confirm and undertake that they are 18+, have full legal capacity, and are not under guardianship (or that they act with the consent of their legal guardian). Neither the Sales Platform nor EQ BİLET shall be liable if these declarations are inaccurate or misused. Users who cannot enter an Event due to non-compliance with these requirements or due to Event Organizer/Event rules shall not direct any claim against EQ BİLET.

9. Minors and Restricted Persons

Parents/legal guardians of minors (under 18) or restricted persons must supervise and control the use of the Sales Platform and, where necessary, prevent such persons from registering or using the Sales Platform and take necessary measures. If a guardian fails to take measures or permits use, any resulting liability rests with the guardian; EQ BİLET shall not be liable.

Terms of Use of the Sales Platform
10. Intermediary Role and Limitation of Liability

EQ BİLET manages the Sales Platform through which tickets for Events organized and operated by Event Organizers are sold. EQ BİLET is not the owner/producer/organizer of the Events offered for sale; it provides ticketing/intermediary services.

Accordingly, the relevant Event Organizer is the primary counterpart for any disruption or negative incident occurring at an Event. EQ BİLET shall not be held liable for situations such as cancellation of an Event, the Event not being as promised, content that infringes rights, causes bodily or economic damage, contains unlawful elements or violates public morals. The User irrevocably agrees to direct their rights and claims to the owner/producer/organizer of the relevant Event and/or other legally responsible parties (including the author/right holder where applicable).

EQ BİLET shall not be liable for disputes arising from reasons not attributable to EQ BİLET.

11. Personal Use and Resale Prohibition

The Sales Platform is intended for personal use only. The User may purchase tickets solely for themselves and for persons attending the Event with them, non-commercially, and in accordance with limits that may be set per Event. The resale or any commercial re-trading of tickets, products, or services purchased via the Sales Platform is strictly prohibited.

12. Prohibited Content and Conduct

Users shall not share or transmit through interactive areas any content that constitutes a crime, requires legal action, violates laws/regulations/communiqués or international agreements, encourages illegal activity, is threatening, harassing, defamatory, insulting, degrading, racist, pornographic, disturbing, politically propagandistic, aimed at attack/protest, or contrary to public morals. Users may not engage in actions that infringe the rights of EQ BİLET, other Users, or third parties.

13. System Security and Automation Prohibition

Users may not use any software or hardware that interferes with the operation of the Sales Platform, and may not use bots, robots, spiders, phishing tools, disruption tools or similar software to perform transactions. EQ BİLET has sole discretion to permit or deny transaction volumes that are inconsistent with reasonable personal use; the User irrevocably accepts this.

EQ BİLET may impose per-User purchase quantity limits for tickets/products/services. Users must comply with such limits. Creating multiple accounts by the same person or using similar methods to exceed limits is prohibited. If EQ BİLET or the Event Organizer detects such violations, EQ BİLET may cancel the relevant order/ticket sale and take measures to prevent further memberships/purchases by the violating person(s); the User irrevocably accepts and acknowledges these measures.

14. Payments

Payments can be made using the payment methods displayed on the website/Sales Platform, including credit cards, debit/TROY cards, and integrated systems of payment service providers, and via credit/financial/banking institutions facilitated by such payment service providers. Payment service providers may, in accordance with the Privacy Notice and where required by law/consent, offer card-saving and “fast checkout” features to enable Users to pay without re-entering card details in subsequent purchases.

The Sales Platform may also provide a “purchase without membership” feature. In such purchases, only information necessary for processing the order is requested. Upon completing the purchase flow, the User may be offered the option to register or continue without registration, and the User irrevocably declares that they complete these actions knowingly and willingly.

15. Suspension / Discontinuation

EQ BİLET may temporarily suspend or fully discontinue the Sales Platform and/or ticket sales/service provision where necessary. EQ BİLET shall have no additional obligations, undertakings, or liability to Users due to such suspension/discontinuation.

16. Advertising/Link Restrictions

Users may not send or transmit any commercial or advertising information, links, or content on the Sales Platform. Users may not solicit to buy/sell products to other Users or conduct advertising activities. Users may not share bank account details, phone numbers, or email addresses.

17. Third-Party Rights and Intellectual Property

Users may not share, link, or transmit any information, software, or other content that violates another person’s privacy rights or infringes copyrights and related rights under the Law on Intellectual and Artistic Works and/or trademark, design, utility model and similar rights under the Industrial Property Law, without permission from the rights holder.

18. Measures for Breach

If the User fails to comply with this Agreement and any additional terms that EQ BİLET may publish, EQ BİLET has sole discretion to restrict or block the User’s access to or use of the Sales Platform. EQ BİLET reserves all legal rights.

EQ BİLET Statements and Undertakings
19. User Content and Removal Right

EQ BİLET is not responsible for what Users write in interactive areas and is not obligated to share such views. EQ BİLET may remove content added by Users without stating any reason.

20. Account Security

EQ BİLET shall not be liable for damages arising from unauthorized access to User data without EQ BİLET’s negligence (e.g., the User sharing credentials, failing to log out, leaving a device unattended, loss/theft of a device).

21. No Warranties

EQ BİLET does not warrant uninterrupted or error-free operation of the Sales Platform, nor does it warrant that specific results will be achieved through use of the website/content or by linking to it. No express or implied warranties or promises are given, including fitness for a particular purpose, uninterrupted continuity, updates, functionality, accuracy, or error-free operation. The Sales Platform and its content are provided “as is”. EQ BİLET does not guarantee that files uploaded/stored/downloaded/shared by Users are free from viruses or harmful elements and shall not be liable for any damages arising from use.

22. External Links

EQ BİLET may enable Users to navigate to third-party websites. EQ BİLET shall not be liable for any damage, loss, or negative outcome arising from the content of such third-party websites. The User acknowledges and irrevocably accepts that they proceed knowingly.

Protection of Personal Data and Confidentiality
23. Personal Data

EQ BİLET processes, transfers, stores, and disposes of personal data in compliance with KVKK and, where applicable, GDPR. For details, please review the EQ BİLET Privacy Notice (KVKK & GDPR) available on the Sales Platform.

24. Confidentiality

EQ BİLET undertakes to keep confidential information received via the Sales Platform or printed forms strictly private and to take necessary measures to prevent unauthorized use or disclosure. Such information may be used to communicate regarding services received, improve user experience, develop existing services, create new services and provide personalized services; and may also be used (without disclosing the identity of the relevant person) for statistical assessments, database creation, market research, partners’ marketing campaigns, annual reports and similar reports, and for processing/retention/transfer for the necessary period to achieve these purposes, including in anonymized form. The User acknowledges that EQ BİLET may store and use usage statistics as described in the Privacy Notice and that such information may be anonymized and shared with third parties.

25. Payment Information

Financial information collected by EQ BİLET is used for invoicing purchased products/services. When an order/purchase is made, the User’s financial information is transferred to the necessary third parties (banks, card schemes, etc.) solely for the purpose of completing the transaction. Information shared may include the card number, expiry date, and CVV2 to the extent required for processing.

In secure transactions, no person/entity other than the User and the issuing bank can access the User’s card information. The payment page transmits card details directly to the bank/payment provider POS systems and displays the result to the User. Card information is not transmitted via email or similar methods and is not stored by EQ BİLET. EQ BİLET cannot access card data transmitted as part of the online transaction. The User acknowledges and irrevocably accepts these points.

The User acknowledges that certain information and documents related to tickets/products/services, EQ BİLET’s operational methods and contractual terms, fundamental characteristics of the transaction (type, quantity, number, related event, price including VAT), membership information protected under these terms, correspondence between the Sales Platform and the User, information about the Sales Platform database/operation learned through special effort without the data subject’s consent, trade secrets, and all written/oral commercial, financial, technical information learned during the relationship are confidential. The User undertakes not to disclose such information to third parties during and after the Agreement without EQ BİLET’s permission and accepts joint and several liability for breaches, including compensation for damages (including those arising from unfair competition).

Cancellation and Refund Policy
26. No Right of Withdrawal for Tickets

The User acknowledges that ticket sales are generally final and that, pursuant to Article 15(g) of the Regulation on Distance Contracts referenced by Article 48/7 of the Turkish Consumer Protection Law, there is no right of withdrawal for event tickets. Accordingly, the User cannot return tickets based on a right of withdrawal and cannot request a refund of the sale price, as stated in the Pre-Information Form and the related distance sales contract; the User irrevocably undertakes not to attempt to violate these provisions.

27. Event/Venue Rules and Other Conditions

The User acknowledges that cancellation/refund conditions are regulated under the Distance Sales Contract and applicable policies in cases such as failure to fulfill delivery conditions correctly, violation of Event/Venue/Organizer rules, wear/tear, deformation or loss of the ticket, or force majeure; and that EQ BİLET may not accept liability in certain circumstances. The User irrevocably undertakes not to attempt to violate these conditions.

Intellectual Property Rights
28. Platform Content

All information, content, software, design, presentation, drawings, visuals, audio recordings and their arrangement/revision and the manner of use/presentation on the Sales Platform and other service channels (excluding third-party content) are protected and belong to EQ BİLET under the Law on Intellectual and Artistic Works and the Industrial Property Law. Such content may not be copied, communicated to the public, reproduced, used, or processed in whole or in part without permission. The User irrevocably undertakes to act accordingly.

29. User-Uploaded Content

Users must ensure that any content uploaded to the Sales Platform does not infringe third-party copyrights or other rights and is not unlawful. If EQ BİLET is notified by a right holder/representative or otherwise becomes aware (including by court decision, admission, or strong indications) that content is unlawful or infringing, EQ BİLET has sole discretion to cancel the User’s access and/or usage rights. The User acknowledges and irrevocably accepts these provisions.

Miscellaneous
30. Term

This Agreement enters into force for an indefinite period upon the User’s acceptance during registration or at the time of purchasing a ticket without registration.

31. Notices

The email address and other contact details provided by the User to EQ BİLET are deemed valid communication channels for all notices under this Agreement.

32. Governing Law and Jurisdiction

This Agreement and any dispute arising out of or relating to it shall be governed by Turkish law. The Istanbul (Central/Çağlayan) Courts and Enforcement Offices shall have exclusive jurisdiction, without prejudice to the rights arising from disputes within the remit of Consumer Arbitration Committees and Consumer Courts.
